Reviewer Service (“we,” “our,” or “us”) is a product powered by Ivory Sights, a division of Meyers Media LLC, based in Gilbert, Arizona, USA.
These Terms govern your access to and use of our website, software, and automation systems (collectively, the “Service”).

1. About Reviewer Service
Reviewer Service helps businesses automate the process of collecting and managing customer reviews via SMS, email, and web links.
We provide this service through GoHighLevel, Twilio, and other approved third-party integrations.
All payments and service relationships are between you and Meyers Media LLC (dba Ivory Sights).

2. Eligibility
You must be at least 18 years old and authorized to represent your business.
By subscribing, you confirm that you have obtained all required permissions to use this Service for your business communications.

3. Payments
All payments are securely processed through Stripe or another PCI-compliant provider.
By subscribing, you authorize recurring charges according to your selected plan.
Failure to pay may result in suspension or cancellation of your account.

4. Refunds
Refunds may be issued at our discretion and only for the current billing cycle.
We are not legally obligated to provide prorated or retroactive refunds.

5. Account Access
Depending on your plan, you may receive login credentials or we may manage your account directly.
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

6. Client Responsibility for Consent
By using Reviewer Service, you acknowledge and agree that:
• All customer contact data you upload has valid, documented opt-in consent for SMS, email, and other electronic communications.
• You comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and GDPR where applicable.
• You will honor all unsubscribe, STOP or OUT requests immediately.
Any misuse, including uploading purchased lists or messaging without consent, may result in suspension and liability for any legal or carrier penalties.

7. Review Gating & Incentives
Reviewer Service and Ivory Sights do not endorse or encourage review gating (sending review links selectively to satisfied customers).
If you choose to filter, gate, or incentivize reviews, you assume full responsibility for compliance with Google, Yelp, FTC, and any applicable regulations.
We disclaim all liability for account suspension, penalties, or damages resulting from such practices.

8. User-Generated Content
We may display, publish, or transmit customer feedback collected through your campaigns.
You retain ownership of all customer content, but grant Reviewer Service permission to transmit and process that data as needed to deliver the Service.
You are responsible for ensuring that no data you upload infringes on any third party’s rights.

9. Cancellation & Data Deletion
We are not liable for indirect or consequential damages, including lost profits or data. You may cancel your subscription anytime through Stripe or by contacting [email protected].
Accounts remain active through the paid period; data is deleted within 30 days after cancellation unless required for compliance retention.

10. Intellectual Property
All software, templates, and designs associated with Reviewer Service are owned and licensed by Meyers Media LLC (dba Ivory Sights).
You may not copy, resell, or modify them without written consent.

11. Limitation of Liability
Reviewer Service is provided “as is.”
We are not liable for indirect, incidental, or consequential damages, including lost profits or reputation loss arising from your use of the Service.
Your sole remedy for any dispute shall not exceed the total amount paid during the prior billing cycle. Our total liability for any claim shall not exceed $1,000 USD or the total amount you paid within the last six months—whichever is less.

12. Indemnification
You agree to defend, indemnify, and hold harmless Meyers Media LLC, Ivory Sights, and Reviewer Service from any claim, fine, or loss resulting from:
• Messaging contacts without proper consent,
• Review gating or incentive violations, or
• Misuse of integrations or customer data.
